Definitions
A consumer within the meaning of § 13 BGB (German Civil Code) is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur within the meaning of § 14 BGB is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its trade, business or profession.
Conclusion of contract
The presentation of products in our online store does not constitute a binding offer; it is an invitation to you to place an order (an invitation to treat). By clicking the order button at the end of the checkout process, you place a binding offer to purchase the goods in your cart.
After you submit your order, we send an automatic acknowledgement email confirming that we have received it. This acknowledgement does not yet constitute acceptance of your offer. A contract is concluded only when we declare our acceptance in a separate confirmation email or when we dispatch the goods to you, whichever occurs first.
Contract language and storage of the order text
The language available for concluding the contract is English. We store the text of your order and send you the order details by email. You can review your past orders in your customer account where one has been created.
Prices and payment
All prices stated in the store are in Euro (€) and include statutory German value added tax (VAT). The total price applicable to your order, including any applicable shipping costs, is shown to you clearly before you submit your order at checkout.
Accepted payment methods
We offer a range of payment methods, which are displayed during checkout. These may include, by way of example:
- Credit and debit card (for example Visa, Mastercard)
- PayPal
- Klarna
- Other methods shown at checkout from time to time
Payment is due immediately upon conclusion of the contract, unless a different due date is stated for the selected payment method. Where you select a payment service provider, the terms of that provider apply in addition to these Terms.
Default of payment
If you fall into default with a payment, we are entitled to claim statutory default interest. Our right to claim further damages caused by the default remains unaffected. For consumers, the statutory default interest rate applies.
Delivery and shipping
Deliveries are made in accordance with our Shipping Policy, which forms part of these Terms and sets out delivery areas, times and costs. Unless otherwise agreed, goods are delivered to the address you provide at checkout.
We are entitled to make partial deliveries where this is reasonable for you, for example where individual items in an order are available at different times. We do not charge additional shipping costs for partial deliveries that we initiate.
Passing of risk
For consumers, the risk of accidental loss of or accidental damage to the goods passes to you only when the goods are handed over to you, regardless of whether the dispatch is insured. For entrepreneurs, the risk passes once the goods are handed over to the carrier.
Retention of title (Eigentumsvorbehalt)
The delivered goods remain the property of LCJ Group GbR until full payment of the purchase price has been received. You may not pledge the goods or assign them as security before ownership has passed to you.
Right of withdrawal
If you are a consumer, you have a statutory right to withdraw from the contract within fourteen (14) days without giving any reason. The full statutory withdrawal instructions, the conditions and consequences of withdrawal, and the model withdrawal form are set out in our Refund & Return Policy.
Consumers enjoy a 14-day right of withdrawal. For full instructions and the model withdrawal form, see our Refund & Return Policy.
Statutory warranty (Gewährleistung)
Your statutory rights in the event of defects apply (§§ 434 ff. BGB). Where the goods are defective, you are entitled to the statutory remedies, including supplementary performance, withdrawal from the contract, a reduction of the purchase price and, where applicable, damages.
For consumers, the limitation period for claims based on defects is two (2) years from delivery of the goods in the case of new goods. This does not affect any voluntary manufacturer guarantee that may apply in addition to your statutory rights.
Reporting a defect
If you discover a defect, please contact us at support@dsneun.de with your order number and a description of the issue. Reporting a defect is not a condition of your statutory rights, but it helps us resolve the matter quickly.
Product availability
All items in the store are offered subject to availability. If an item you have ordered becomes unavailable after the contract has been concluded, for example because our supplier fails to deliver to us through no fault of our own, we will inform you without undue delay and will refund any payment you have already made for that item without delay.
This provision does not limit your statutory rights, in particular your rights in the event that we are responsible for the unavailability.
Limitation of liability
We are fully liable, without limitation, for damages arising from intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit), for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
For damages caused by slight negligence (leichte Fahrlässigkeit), we are liable only where an essential contractual obligation (a cardinal duty, the fulfilment of which is necessary for the proper performance of the contract and on which you may regularly rely) is breached. In such cases our liability is limited to the foreseeable damage typical of this type of contract.
Any further liability on our part is excluded. The above limitations also apply in favour of our legal representatives, employees and vicarious agents.
Intellectual property
All brand names, logos, designs, product graphics, photography, text and other content of the DangerousStreet store are owned by or licensed to LCJ Group GbR and are protected by copyright, trademark and other intellectual property rights. You may not reproduce, distribute, modify or otherwise exploit any such content, in whole or in part, without our prior written consent.
Order cancellation by the seller
We may cancel an order and refund any amount you have paid in the following cases:
- where an ordered item is unavailable and cannot be supplied;
- where the listing contained an obvious and recognisable pricing or description error;
- where there is a reasonable suspicion of fraud or other misuse of our store.
This right of cancellation is separate from, and does not affect, your statutory right of withdrawal described in section 06.
Applicable law and jurisdiction
The law of the Federal Republic of Germany applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection afforded by the mandatory consumer-protection provisions of the law of the country in which you have your habitual residence. Those mandatory provisions remain unaffected.
Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), available at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). Further information is set out in our Legal Notice.
Final provisions
Should any provision of these Terms be or become invalid, ineffective or unenforceable in whole or in part, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory provision.
All orders placed through the DangerousStreet store are concluded with and fulfilled by LCJ Group GbR, Bahnhofstr. 12, 69493 Hirschberg an der Bergstraße, Germany.
